Privacy Policy – “Gindi Holdings” Group

Gindi Holdings Ltd. (including related companies and/or any other corporation in the “Gindi Holdings” group, hereinafter: “the Company” and/or “Gindi” and/or “we“) are committed to protecting the privacy of users of Gindi’s website at gindih.co.il and all company websites and services offered on the company websites (all together: “the Website“) for users (“user/s“, “you“). You can get information about other group companies here and/or on their dedicated websites, if they exist (all together referred to as – “group companies“).

This privacy policy (hereinafter: “Privacy Policy“) was created to inform you about the way we process, collect and use personal information and non-personal information (as defined below) that you provide us through the Website. In addition, the privacy policy below describes the measures we take to secure the information collected by us and how you can contact us regarding this policy.

Use of the Website and services offered on it and/or provision of personal information by the user, as relevant, constitute your consent to the collection of personal information and use of personal information by Gindi for the purposes detailed in this privacy policy and in accordance with its other terms. Therefore, if you do not agree to any term or provision in this document, you are requested not to use the Website and/or view it.

  1. Definitions and Interpretation:
  1. “Personal Information” –data relating to an identified person or one who can be identified with reasonable effort, directly or indirectly. This is information that you knowingly provide, with your consent, for the purpose of receiving information and services presented on our website.
  2. “Non-Personal Information” – information that by itself does not allow identification or contact with you. This is technical information or anonymous information or statistical and aggregated information that as mentioned does not allow identification of the user using reasonable efforts. For example, device type, browser type, operating system, language, as well as statistical information related to the scope of website use including date and time of use, duration of use, frequency of use, usage history, advertisements you saw on the website, offers and services that interested you, pages viewed, including pages that linked users to the website. Subject to legal provisions, Gindi may use this information without limitation, and it is used mainly for operating the website, analyzing trends, improving the website, its content and user experience, for statistics and internal analysis purposes, and for improving Gindi’s marketing efforts.
  3. The division in this privacy policy into sections and section headings is for convenience only and shall not be used for interpretation purposes.
  4. This privacy policy is written in masculine language for convenience and applies equally to both genders. Everything stated in this privacy policy in singular form – also means plural.

  1. The scope of this privacy policy is limited to information collected through your use of the Website services (whether such use is through any computer used to access the Website services, including without limitation, desktop computer, laptop, mobile phone or any other electronic device).
  2. Collection of personal information and its use are done in accordance with applicable law, including the Privacy Protection Law, 5741-1981 (“Privacy Protection Law“). Gindi is the “database controller” (according to the definition of “controller” in the Privacy Protection Law) regarding personal information collected in the context of using the Website and related services. For any question related to the privacy policy, collection and use of personal information and exercising your rights regarding personal information, you can contact us through the contact methods detailed at the bottom of this policy.
  3. The user has no legal obligation to provide personal information. Providing personal information as mentioned depends on the user’s will and consent. However, providing certain personal information may be necessary for fulfilling the purpose of its collection, as detailed in this privacy policy. If you choose not to provide this information, you will not be able to receive the response and/or requested service and/or they will be provided in lower quality. For example, if you want to contact us for answers to certain questions, this cannot be done without receiving contact details.
  4. When you choose to provide personal information to Gindi, you declare and undertake that the personal information you provided or will provide is complete and accurate. In case of any change or update in the information, you undertake to update Gindi. It is clarified to you, and you agree that the personal information will be stored in Gindi’s databases which will be entitled to process it and transfer it to third parties as detailed in the privacy policy.
  1. How does Gindi collect personal information?  
  1. Gindi collects personal information through the Website and various services offered on the Website, including:
  1. Contact us. If you are interested in contacting us, personal information relating to you and your inquiry will be collected in Gindi’s databases. You can contact us through the “Contact” tab on the website. For this purpose, you will be asked to specify your full name, email address, phone number and a free description of your inquiry.
  2. Project interest. You can leave details to receive information about the various projects presented on the website. For this purpose, you will be asked to specify full name, phone, email and confirm receipt of promotional material.
  3. Tenant service. You can contact through the website the project representative where you reside. For this purpose, you will be asked to specify the project name, full name, email address, phone number, building apartment number and a free description of your inquiry. You can also contact by calling: 1-700-737-200 during operating hours.
  4. Customer club. You can leave details to receive information about joining the customer club. For this purpose, you will be asked to specify full name, phone, email and confirm receipt of promotional material.
  5. Landing pages. It is possible that during use of the website or use of the internet and/or use of social networks, you can leave details on various landing pages displaying information related to the customer club and/or various projects presented on company websites or other marketing content.
  1. Purposes of collection and use of information:
  1. We may use your personal and non-personal information for providing Website services, managing it, maintaining it, solving technical problems, improving user experience, services and content offered on the Website, ensuring proper operation of the service or of Gindi websites that will be established in the future.
  2. Adapting website content to your areas of interest and improving the website to suit your areas of interest, including displaying company advertisements using various objects such as COOKIES (see “Use of cookies and monitoring tools”) on other web pages you browse, including on social networks. It will be clarified that the information collected for displaying advertisements as mentioned does not identify you personally but only matches the advertisements that will be displayed to you to topics that may interest you.
  3. For sending messages, by Gindi and group corporations, by email and/or via SMS and/or WhatsApp and/or Telegram (and/or any other media or platform), in order to (a) contact you for administrative purposes, such as customer service or for example updates on changes or improvements relating to the Website; we may also record the communication with you, among other things to help solve problems you may encounter (b) send you marketing and promotional information from Gindi, group corporations or third parties including advertisers, including information about events and activities, deals, discounts, benefits and the like (see “promotional communication”).
  1. Transfer of personal information to third parties:

We may share personal information with trusted third parties who assist us in the following purposes: operating the Website, providing Website services, managing our business and for various statistical needs. These third parties may use your personal information only to the extent required to perform the services they provide for us, and they are obligated to take security measures that comply with the law for maintaining confidentiality and protecting your personal information. Except as detailed in this privacy policy, the personal information you provide will not be transferred to third parties.
  2. Gindi uses the services of third parties for managing advertisements on the Website. These third parties use “cookies” and their monitoring tools for online advertising, all as detailed in this policy (see “Use of cookies and monitoring tools”).
  3. We may be required to provide personal information about you if we believe that such provision is necessary to avoid legal liability, required in the context of compliance with legal proceedings (including, but not limited to, subpoena, search warrant or court order), to protect our rights or property or your rights and property or the rights and property of a third party, to maintain public or individual safety, or to prevent or stop illegal, unethical activity, or activity that could lead to legal claims or in case you violate or attempt to violate the terms of use of the Website or any of the services offered by the Company.
  4. We may sell, transfer or share part or all of our assets, including your personal information, in the context of processes related to organizational change, including merger, acquisition, reorganization, asset sale or in case of bankruptcy.
  1. Promotional communication:
  1. Gindi offers sending electronic and other promotional materials (including via the internet and cellular networks, including messages in SMS, email, WhatsApp, Telegram (and/or any other media), existing or future, including receiving newsletters), which means providing general or promotional mailing directly to users who chose this (“mailing“).
  2. The user who approves receiving mailing, declares and confirms that he knows the provisions regarding sending promotional material as detailed in the Communications Law (Telecommunications and Broadcasting), 5768-2008 (“Communications Law“), and he explicitly agrees that mailing will be sent to him by Gindi and by group companies, in all ways listed in the Communications Law and in any relevant future way. It will be clarified that in order to send you the most appropriate content, use is made of information about you as mentioned above to enable optimal characterization of the types of offers and services most suitable for you.
  3. You may cancel your consent to receive mailing by contacting through links available in messages that will be sent to you and/or by written/telephone contact to the company or through contact means appearing in this policy. The duration of removing the user from mailing lists from the moment of his initial request will not exceed 48 hours for actual implementation. However, removal from the mailing list will not delete the information collected about him from Gindi’s databases, which will be entitled to continue using the information as mentioned in accordance with the purposes listed in this privacy policy. You may re-register to receive mailing as mentioned through contact via customer service or update within the personal account on the website.
  4. Gindi does not provide direct mailing services to others and will not transfer your details and information accumulated about you to third parties for sending direct mailing, unless your consent is obtained for this. However, the Company may use your details for sending marketing offers on behalf of third parties, provided that your details are not transferred to such third parties without your consent. Also, the Company may use service providers on its behalf and in this context transfer various details to them, subject to its commitment to maintain privacy.
  1. Data subject rights:
  1.  Gindi respects your privacy and your control over your personal information. According to the Privacy Protection Law, your rights regarding your personal information in Gindi’s database are as follows:
  1. You may request to view personal information about you that is with Gindi.
  2. You may request correction and/or deletion of personal information about you, if you found that the personal information is not correct and/or not updated.
  3. If you do not want to receive marketing mailing you may, at any time, request your removal from the mailing list through the “removal” option in the marketing message that will be sent and/or according to other instructions that will appear in the mailing received.
  1. You may request to exercise your above rights by contacting the email address gindi@gindih.co.il or through contact via contact means appearing on the website and detailed in the privacy policy. When contacting for correction and/or viewing and/or deletion of personal information as mentioned above, and for protecting user privacy, Gindi may request certain details for identification before providing a response and/or fulfilling the request.
  2. It is clarified that information required by Gindi for managing its business, including documentation of actions performed in connection with service provided, will continue to be preserved according to law, but will no longer be used for contacting you in direct mailing and/or for any other purpose except compliance with legal provisions and/or protecting Gindi’s rights according to law.
  1. Duration of personal information retention: 
  1. Gindi will keep your personal information only for the period of time required for the purposes for which it is processed and in accordance with applicable law requirements. We will review the personal information in our possession from time to time, and if we find that there is no legal, business or customer service related need to continue keeping it – we will delete it securely or, in certain cases, make it anonymous.
  2. However, Gindi may keep your personal information for a longer period in the following cases: (a) when the law or instruction of a supervising authority requires this; (b) when Gindi is contractually obligated to do so; (c) when the information is required for legal protection or for managing disputes.

  1. Gindi takes accepted security measures to maintain confidentiality of data subjects’ information, protect their privacy and reduce the risk of penetration and unauthorized use of personal information, however, absolute protection cannot be guaranteed and there may be security breaches and system penetrations that are beyond Gindi’s reasonable control.
  2. It is known to you and you confirm and agree that Gindi will not be responsible for any damage of any kind, indirect or direct, that will be caused to you and/or anyone on your behalf, if the information is lost, exposed or if any unauthorized use is made of it, and you confirm and agree that you will have no claim and/or demand and/or lawsuit against Gindi and/or anyone on its behalf in the occurrence of these circumstances and due to damages that will be caused to you, if caused, because of them.
  3. Gindi may store personal information both in Israel and in other countries in the world and/or allow access to personal information from countries outside Israel. The user hereby confirms that when using platforms, his personal information may be transferred, stored and processed outside the State of Israel. Transfer of personal information outside Israel’s borders will be done in accordance with applicable law.

  1. Use of cookies and monitoring tools:

We may use Cookies files or other monitoring tools for the ongoing and proper operation of the Website, including for collecting statistical data on Website use, verifying details, adapting the Website to your personal preferences (including third-party advertisements displayed on the Website) and improving information security level. It will be clarified that the collected information does not identify you personally but only matches the content that will be displayed to you, for example advertisements, to topics that may interest you.
  2. Modern browsers allow you to set your preferences regarding receiving Cookies or block them completely. If you are not sure how to do this, you can check the instructions in the help file of the browser you are using.
  1. Age restriction and capacity:

Use of the Website is intended for adults over 18 years old only. If you are not over 18 years old and/or do not have legal capacity, you are required not to make any use of the Website and services offered by Gindi and not to provide us with any information.

The Website may include links and references to other websites, which are owned and/or operated by third parties as well as links to social media such as Facebook and Instagram. It is important to clarify that this privacy policy does not apply to these websites and any use by you of them is subject to their privacy policies. We encourage you to learn about the privacy and security policies of these third parties before providing them with information about you.

  1. Privacy policy update:

We reserve the right to update the privacy policy from time to time. The most updated version will be the binding version regarding the manner of using your personal and non-personal information. If we determine, at our sole discretion, that the changes in the policy are material, we will publish a notice about this on the Website. However, we are not obligated to notify about changes that are not material, and therefore we recommend users to review the privacy policy periodically to stay updated on its binding terms.
